Privacy Policy

Folio is a place for creative people to show their work and find each other. This policy explains what we collect, why, and what you can do about it. It is written to be read, not to be survived.

Folio is operated by Elijah Camacho, a sole proprietor in Virginia, United States, trading as Folio ("we", "us"). We are the data controller for the information described here. Contact: privacy@myfolio.club.

The short version

  • We collect what the app needs to work, and we say what each thing is for.
  • We do not sell your personal information, and we do not show ads.
  • Your date of birth and legal name are visible to nobody but you, not to other users, not on your profile, not through our API.
  • Your precise location is never shown to anyone. It is used to compute distance, and the result of that computation is "nearby or not".
  • You can delete your account and everything in it, from inside the app.

We do not collect

Your contacts. Your photo library, only the specific items you choose to upload. Your GPS position: the map coordinate we hold is the centre of a city you picked from a list, not a reading from your phone. Advertising identifiers. Behavioural data for any advertiser, because there are no advertisers.

The age minimum

Folio is for people aged 16 and over. We ask for a date of birth during signup and refuse accounts below that age. That refusal is recorded against the account so the same account cannot try again with a different answer.

If we learn that we hold an account belonging to someone under 16, we delete it and its contents. If you believe a child has an account here, write to privacy@myfolio.club and we will act on it.

Who we share it with

We use a small number of providers to run the service. They process data on our instructions and may not use it for their own purposes.

We will also disclose information if the law genuinely requires it. If we can tell you that has happened, we will.

We have never sold personal information and have no plans to. We do not share it for cross-context behavioural advertising, which under the CCPA also counts as a sale.

Your rights

Wherever you live, you can:

  • See it, most of it is in the app; write to us for the rest.
  • Correct it, profile fields are editable in Settings.
  • Delete it, Settings → Account → Delete account. This is real deletion, not deactivation.
  • Take it with you, email us and we will send you a machine-readable export of your content.
  • Object, tell us and we will stop, where the law lets us.

If you are in the UK or EEA, our lawful bases are: contract for the things the app cannot work without, legitimate interests for security and abuse prevention, and legal obligation for the age check. You may complain to your data protection authority.

If you are in California, you have the rights above and we will not discriminate against you for using them.

We do not need an account or a fee to answer any of these. Write to privacy@myfolio.club.

Security

Passwords are hashed, never stored or logged in the clear. Traffic is encrypted in transit. Message attachments live in a private store and are reachable only through short-lived signed links. Your date of birth, legal name and coordinates are protected at the database level by permissions that do not grant read access to anyone but you, not merely hidden by the app.

No service is perfectly secure, and we would rather say so than imply otherwise.

International transfers

We are based in the United States and our providers store data there. If you are outside the US, using Folio means your information is transferred there, under the standard contractual clauses our providers maintain.

Changes

If we change this in a way that matters, we will tell you in the app before it takes effect, not by quietly editing this page. The date at the top always reflects the current version.

Terms of Service

These are the rules for using Folio. Folio is operated by Elijah Camacho, a sole proprietor in Virginia, United States, trading as Folio ("we", "us"). By creating an account you agree to them.

1. You must be 16 or over

Folio is for people aged 16 and over. There is no younger tier and no parental-consent route. We ask for your date of birth when you sign up, and an account that fails that check cannot be used.

Giving a false date of birth to get in is a breach of these terms, and we will close the account when we find out.

2. Your account

Keep your password to yourself. You are responsible for what happens under your account. Tell us at support@myfolio.club if you think someone else is in it.

One person, one account. You may not sell, rent or transfer an account, or take a username in order to sit on it or resell it.

3. Your work stays yours

You own everything you post to Folio. We do not claim any ownership of it. This matters more here than on most services, so it is worth being exact:

To run the service, you give us a non-exclusive, worldwide, royalty-free licence to host, store, resize and display your content, solely for the purpose of operating and promoting Folio. That licence exists so that we may put your work on other people's screens, generate thumbnails, and show it in feeds and search.

That licence:

  • Ends when you delete the content, other than copies in routine backups, which are purged within 30 days.
  • Does not let us sell your work, license it to anyone else, or use it in paid advertising without asking you first and getting a yes.
  • Does not let us train machine-learning models on your work, or let anyone else do so through us.

If we ever want to feature your work in our own marketing, we will ask.

4. What you may not post

  • Work that is not yours to post, or that infringes someone's copyright, trademark or moral rights. Passing off another creator's work as your own is the fastest way to lose an account here.
  • Sexual content involving minors, in any form, real or drawn or generated. This is reported to the authorities, not merely removed.
  • Sexually explicit material, gratuitous violence, or content whose purpose is to shock.
  • Harassment, threats, hate speech, or content attacking people for who they are.
  • Content promoting self-harm, eating disorders, or suicide.
  • Illegal goods and services, fraud, scams, malware, phishing.
  • Impersonating another person, brand or studio.
  • Automated scraping, bulk downloading of other people's work, or any attempt to break, overload or reverse-engineer the service.
  • Spam, including unsolicited pitches sent at volume through messages.

5. Moderation

We may remove content or suspend an account that breaches section 4. Where we can, we will tell you what was removed and why, and you may reply to support@myfolio.club. For serious cases, child safety above all, we act first and explain afterwards.

We are not obliged to host anything, and removing content does not make us the author of what remains.

6. Copyright complaints

If your work is on Folio without permission, write to copyright@myfolio.club with: the work concerned, where it appears on Folio, your contact details, a statement that you believe the use is unauthorised, and a statement that your report is accurate. We will remove or disable the material and tell the person who posted it, who may respond.

Repeat infringers lose their accounts.

7. Collaborations, events and messages

Folio helps people find each other. It is not a party to anything they agree. Fees, deliverables, credit, safety at a shoot or an event: those are between the people involved. We do not vet users, verify claims, hold money, or guarantee that anyone turns up.

Use ordinary judgement when meeting people you met online.

8. Ending it

You can delete your account at any time in Settings → Account → Delete account. Your content goes with it.

We may suspend or close an account that breaches these terms, or where we must in order to comply with the law. If we close your account without cause, and you have paid us for anything, we will refund the unused part.

9. No warranty

Folio is provided as it is. We do not promise it will be uninterrupted, error-free, or that anything you post will be seen by anyone. Back up your own work. Folio is a place to show a portfolio, not the only place your files should exist.

10. Liability

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost opportunities, or lost data. Where liability cannot be excluded, it is limited to the greater of what you have paid us in the previous twelve months, or fifty US dollars.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, and some jurisdictions do not allow the exclusions above, in which case they do not apply to you.

11. Changes

We may change these terms. If a change matters, we will tell you in the app before it takes effect. Continuing to use Folio after that means you accept it.

12. Governing law

These terms are governed by the laws of Virginia, United States, and the courts of Fairfax County, Virginia have exclusive jurisdiction, except that if you are a consumer in a country whose law gives you the right to sue locally, that right is untouched.

13. Apple

If you got Folio from the App Store: these terms are between you and us, not Apple. Apple has no obligation to support the app. Apple is a third-party beneficiary of these terms and may enforce them.

Support

Folio is a place for creative people to show their work and find each other. If something is broken, or you need something done to your account, this is where to start.

Email: support@myfolio.club, we aim to reply within two working days.

Common things

I can't get in

  • Forgotten password, on the log in screen, tap *Forgot your password?* We'll email you an 8-digit code. Codes last 15 minutes.
  • Forgotten username, you don't need it. Log in with your email address instead. Your username is on your profile once you're back in.
  • You signed up with Google or Apple: those accounts have no password, so the password form will always refuse them. Use the *Continue with Google* or *Continue with Apple* button.
  • The code never arrived, check spam, then request a new one. If two attempts produce nothing, email us with the address you used.

I'm under 16

Folio is 16 and over. If the date of birth you gave puts you under 16, the account can't be set up, and that decision stays with the account: a new device or a reinstall won't change it. You're welcome back when you're 16.

I typed my date of birth wrong

Write to support@myfolio.club from the address on the account. We can't undo an age decision on request, that would defeat the check, but if you can show the date was a genuine slip, we'll look at it.

Deleting my account

Settings → Account → Delete account. This removes your profile, posts, media, messages, collections and follows. It is not reversible and there is no deactivation-then-return.

If you'd rather take your work with you first, email us and we'll send you an export.

Reporting something

  • Content that breaks the rules, use the report control on the post, profile or message.
  • Someone using your work without permission, copyright@myfolio.club. See §6 of the Terms for what to include.
  • Child safety, safety@myfolio.club. These are read first and acted on first.
  • A security flaw, security@myfolio.club. Please give us a reasonable chance to fix it before publishing. We won't pursue anyone who reports in good faith and doesn't access other people's data.

My work isn't reaching anyone

Local is built on the city on your profile. Without one, your work has no Local feed to appear in and you won't see anyone else's. Settings → Edit profile → City.
